AI Real Estate Photo Editing and Virtual Staging is Under Attack!

Starting January 1, 2026, California is implementing a new law that places strict requirements on the use and disclosure of digitally altered and AI-edited real estate photos.

While that law does not apply in Georgia, it’s worth paying attention, because changes like this often influence MLS rules, policies, and even laws against AI real estate photo editing in other states over time.

Georgia Rules for Virtual Staging

Here in Georgia, we already have clear guidance from Georgia MLS when it comes to listing photos and virtual edits.

Georgia MLS allows powerful marketing tools. Drone photos, twilight images, collages, and even virtually staged photos (likely using AI real estate photo editing) but there are guardrails, especially around accuracy and disclosure.

When it comes to virtually staged photos, Georgia MLS is very clear:

Photos must not be deceptive

  • Virtually staged images must be disclosed as “virtually staged” in the public remarks

  • A true “before” and “after” image must be included, shown immediately before or after each other

  • The images must reflect the property’s actual condition without altering fixed or structural features

Virtual staging can include furniture, rugs, artwork, plants, and realistic landscaping improvements.

It cannot include things like fake views, added fireplaces, pools, property additions, or the removal of elements outside the owner’s control.

Georgia MLS even allows a virtually staged image as the primary photo, as long as the before-and-after images are included together in a collage.

When we provide virtual staging, you’ll always receive both the original image and the staged version, so you have exactly what you need to remain compliant with Georgia MLS rules (and GREC).

Bottom line:

California’s new law is about truth in advertising, and the Georgia Real Estate Commission and Georgia MLS already shares that same intent.

Market creatively — but always market honestly.

AI real estate editing can be a powerful and effective as a marketing tool when used responsibly. Enhancements such as virtual staging, twilight effects, and minor visual improvements can help buyers better understand a property’s potential, but they must never misrepresent reality.

As MLS rules and state regulations continue to evolve, transparency and disclosure are essential. When AI real estate editing is applied thoughtfully, clearly disclosed, and paired with accurate “as-is” images, it supports honest marketing, protects buyer trust, and helps agents remain compliant while still showcasing a home at its best.

What We Do

As part of our standard workflow, we include certain non-structural visual enhancements with every photography assignment. These commonly include changing overcast skies to blue with white clouds, enhancing (not replacing) green grass when needed, and adding virtual fires to fireplaces where applicable. These edits are intended to improve visual clarity and presentation, not to misrepresent the property.

Our clients may request that any or all of these edits not be applied. Regardless of whether these enhancements are used, the most important factor remains transparency, agents are encouraged to disclose any virtual or digital edits in accordance with MLS guidance.
